These Terms of Use (“Terms”) form a legally binding agreement between you (“User,” “you,” or “your”) and Shay Alon Vash, the owner and provider of the mobile application known as Crypto Trading Academy (“Application,” “App,” “we,” “us,” or “our”).
By downloading, installing, or using the Application on any compatible mobile device, you agree to be bound by these Terms. If you do not agree, do not install or use the Application.
License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on any compatible iOS or Android device that you own or control, solely for your personal, non-commercial use.
You may not:
- Sell, rent, lease, lend, sublicense, or distribute the Application to others;
- Reverse engineer, decompile, disassemble, modify, or attempt to derive the source code of the Application (except as permitted by applicable law);
- Use the Application for any unlawful, fraudulent, or unauthorized purpose.
Your use of the Application must comply with the Apple App Store and/or Google Play Store terms of service.
Educational Purpose
The Crypto Trading Academy Application is an educational and entertainment tool designed to teach users about cryptocurrency trading concepts through simulations and interactive mini-games.
It does not involve or facilitate real financial transactions, the purchase, sale or transfer of actual cryptoassets, or connection to crypto exchange accounts or wallets. All trading in the Application uses virtual funds.
All data, including live market data displayed in the App, is for educational and illustrative purposes only.
No Financial Advice or Signals
The Crypto Trading Academy Application is not a financial advisory service or signal provider. All content, simulations, and educational materials are for informational and educational purposes only and should not be construed as investment advice, financial guidance, or trading recommendations.
You acknowledge and agree that:
- You are solely responsible for any decisions you make based on your use of the Application;
- No content provided through the Application constitutes a solicitation, offer, or recommendation to buy or sell any cryptoasset or other financial instrument; and
- We make no guarantees of performance, profitability, or success in real trading.
Consent to Use of Data
You agree that we may collect and use technical and usage data—such as device information, operating system details, and performance metrics—to maintain and improve the Application. Personal data will be handled in accordance with our Privacy Policy.
Subscription and Refund Policy
The Application is free to download and use. Certain premium features may be available through an optional paid subscription.
All subscription payments are processed through the App Store or Google Play. Refund requests will be reviewed and decided on a case-by-case basis, in accordance with applicable platform policies and our discretion. We reserve the right to deny refunds if the user has accessed or used premium features after purchase.
Termination
This Agreement remains in effect until terminated by you or by us. Your rights under these Terms will automatically terminate without notice if you fail to comply with any provision. Upon termination, you must cease all use of the Application and delete all copies from your devices.
Third-Party Services and Market Data
The Application may display or provide access to third-party data, content, or services (“External Services”), including live cryptocurrency market data from external sources. You acknowledge that:
- We do not control or guarantee the accuracy or availability of third-party data;
- We are not responsible for the content or reliability of any External Services; and
- Your use of such services is entirely at your own risk and may be subject to third-party terms.
No Warranty
THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, AND NON-INFRINGEMENT.
No advice or information obtained from us shall create any warranty not expressly stated herein.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE THE APPLICATION.
OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE APPLICATION OR PREMIUM ACCESS IN THE 12 MONTHS PRIOR TO THE CLAIM.
YOU AGREE TO HOLD US HARMLESS FROM ANY CLAIMS, LOSSES, OR DAMAGES ARISING FROM YOUR USE OF THE APPLICATION OR RELIANCE ON ITS CONTENT.
Class Action Waiver
You agree that any dispute shall be resolved on an individual basis only, and that you will not participate in any class, collective, or representative action against us. You further waive any right to a trial by jury.
Export and Compliance
You agree to comply with all applicable export control laws and regulations. You represent that you are not located in any jurisdiction subject to embargoes or restrictions imposed by Israel, the United States, or other applicable authorities.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles.
You agree that any dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Tel Aviv, Israel.
Platform Terms and Third-Party Beneficiaries
- For iOS Users: You acknowledge that these Terms are between you and Shay Alon Vash, not Apple Inc. Apple is not responsible for the Application or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms.
- For Android Users: You acknowledge that these Terms are between you and Shay Alon Vash, not Google LLC. Google is not responsible for the Application or its content. Google and its affiliates are third-party beneficiaries of these Terms.
Changes to Terms
We may update these Terms at any time. Updates will take effect upon posting in the Application or on our website. Continued use of the Application after such updates constitutes your acceptance of the revised Terms.
